These terms comprise (A) the Terms of Use and (B) the Terms of Sale of Classes Ayazpoor ("the app", "we"), available at https://classes.ayazpoor.fr and through the matching Android mobile app.
A. Terms of Use
1. Purpose and acceptance
These Terms of Use govern access to and use of the app. By creating an account or using the app, you accept them in full. If you do not agree, do not use the app.
2. Access and account
Access requires signing in with Ayazpoor ID (login.ayazpoor.fr). You are responsible for keeping your sign-in secure and for activity carried out from your account. The app is intended for people aged 13 and over; minors use it under the responsibility of a teacher or legal guardian.
3. Description of the service
The app lets teachers create courses, lessons, exercise sets, flashcards and games, invite students and grade their answers; and lets students follow courses, answer exercises (text, audio, video, photo, multiple choice, fill-in-the-blank) and revise. Features may change, be added or removed over time.
4. Acceptable use
You agree not to: (a) post unlawful, hateful, defamatory or violent content or content that infringes others' rights; (b) upload content you have no rights to; (c) attempt unauthorised access to accounts, data or systems; (d) disrupt the service or misuse it beyond its educational purpose; (e) harvest other users' data. We may remove any content and suspend any account for breach.
5. Content
You keep ownership of the content you create or upload. You grant us a non-exclusive, royalty-free licence, limited to hosting, displaying and processing that content solely to provide the service (for example, showing your answers to your teacher). Teachers are responsible for the content they publish in their courses.
6. Intellectual property
The app, its brand, interface and code are protected and remain our property or that of our licensors. No rights are granted beyond the right to use the app in accordance with these terms.
7. Availability and liability
The service is provided "as is". We strive to keep it available but do not guarantee it will be uninterrupted or error-free. To the extent permitted by law, we are not liable for indirect damages or loss of data; nothing here limits your statutory rights as a consumer.
8. Suspension and termination
You may stop using the app at any time and request deletion of your account. We may suspend or close an account for breach of these terms or misuse.
9. Personal data
How we handle your data is described in our Privacy Policy.
10. Changes and governing law
We may amend these Terms of Use; the date above shows the current version. These terms are governed by French law, and disputes are subject to the competent courts, without prejudice to consumer-protection rules.
B. Terms of Sale
1. Scope
Core features may be offered free of charge. These Terms of Sale apply to any paid offer (subscription or purchase) that may be offered in the app. For a purchase, these Terms of Sale prevail over the Terms of Use in case of conflict.
2. Prices
Applicable prices are those displayed at the time of order, in euros, inclusive of all taxes (applicable VAT included). We may change prices; new prices apply to later orders.
3. Ordering
Your order is confirmed once you have validated the offer, the price and the payment. A summary is provided. Placing an order constitutes acceptance of these Terms of Sale.
4. Payment
Payment is made through our secure payment provider and/or through the billing of the distribution platform (Google Play), depending on the purchase channel. We do not store your card details.
5. Delivery / activation
Offers are digital services activated immediately after payment, with no physical medium.
6. Right of withdrawal
As an EU consumer, you generally have 14 days to withdraw. However, for digital content or services supplied immediately, by placing the order you expressly consent to immediate performance and waive your right of withdrawal once the service is fully performed, in accordance with applicable consumer law.
7. Subscriptions and renewal
Subscriptions run for the stated period and may renew automatically unless cancelled before the renewal date from your account or, for purchases via Google Play, from your Google account's subscription settings. Cancellation takes effect at the end of the current period.
8. Refunds
Any refunds are handled in accordance with applicable law and, for purchases via Google Play, with Google's refund policy.
9. Disputes
For any complaint, contact us first at [email protected]. Failing agreement, you may use a consumer mediator or the EU online dispute resolution platform (ec.europa.eu/consumers/odr). Governing law: French law.
